The Korf Family Foundation (legal name The Korf Family Foundation Inc, EIN 20-3942766) was a US private foundation run by the Miami businessman Mordechai Korf and Nechama A. Korf.[1] Its Form 990-PF returns cover the tax years ending November 2006 to November 2021, the last marked as its final return.[2][3] Over that period it reported $13,748,045 in contributions received and $14,716,827 in grants paid, mostly to Chabad-Lubavitch institutions in Florida and New York and to the Federation of Jewish Communities of the CIS. Nearly all of its money came from Mordechai Korf himself. In one year, the year to November 2013, four Optima-named companies at 200 South Biscayne Boulevard, Miami, gave it $1,545,000 between them, and in the year to November 2017 a fifth, Optima International of Miami Inc, gave $100,000.[4][5]

Context

Status: allegation. In 2020 the US Department of Justice filed civil forfeiture complaints alleging that Ihor Kolomoisky and Gennadiy Bogolyubov defrauded PrivatBank, and that their associates Mordechai Korf and Uriel Laber "created a web of entities, usually under some variation of the name 'Optima,' to further launder the misappropriated funds".[6] Korf and Laber are not defendants. They appear in the cases as claimants, and they deny any wrongdoing; no criminal charge against either man has been found. The press has reported their foundations' giving to Chabad charities, and no source has traced any of the alleged proceeds to those charities.[7][8] The full account, with the two men's response, is on Chabad and Ukraine. The tables below record lawful grants and donations as the foundation reported them to the Internal Revenue Service. They are not evidence of tracing.

Contributions received and Schedule B

Each 990-PF reports total contributions on Part I line 1. A foundation that received $5,000 or more from any one contributor must attach Schedule B naming them; line 2 is a box to tick if it was not required to do so.[9] A private foundation's Schedule B is open to public inspection, and none of the Schedule B pages found has any redaction.

Editor's note: in the returns for the tax years ending Nov 2010 ($600,000), Nov 2012 ($300,000), Nov 2014 ($1,160,667) and Nov 2020 ($15,000), the foundation ticked Part I line 2, which says it was "not required to attach Schedule B", and no Schedule B is attached, although the contributions reported on line 1 were above $5,000. Under the IRS "General Rule", a private foundation must list every contributor who gave $5,000 or more during the year.[9] Unless all of those gifts came from donors who each gave less than $5,000, which the returns do not suggest, the box and the figures sit awkwardly together. This is an apparent inconsistency on the face of the returns, noted by this page. It is not a finding by the IRS or any other regulator, and no source has been found that comments on it. In Nov 2008 ($100), Nov 2011 ($1,923), Nov 2018 ($1,500) the contributions were under $5,000, so ticking the box was consistent with the rules.

The year to November 2013

The return for the year to 30 November 2013 is the only one with contributors other than Mordechai Korf. Four companies at 200 South Biscayne Boulevard, Miami, gave $1,545,000 between them, and the five gifts add up exactly to the $2,368,000 on line 1. The e-filed version codes all five as "person" contributions, and gives 5251 36 Street LLC and Optima Group in the field for individual names.[4]

Other years

  • Year to November 2015: line 1 reports $870,000, but Schedule B lists only Mordechai Y. Korf, with $840,000. The remaining $30,000 is not itemised, which is allowed if it came from donors who each gave less than $5,000.[17]
  • Year to November 2017: no scan of this return is on ProPublica, but the e-filed return is. Its Schedule B names a single contributor, Optima International of Miami Inc, 200 South Biscayne Boulevard, Miami, with $100,000.[5]
Editor's note: the Forward reported in 2020 that "at least three shell entities named in the lawsuit", meaning PrivatBank's Delaware suit, had given "hundreds of thousands of dollars since 2013 to the Korf Family Foundation".[7] The Optima-named contributors above fit that description in date and size. This page has not checked which of them, if any, are named in that suit.

Sources and gaps

  • Tax years ending 2010 onwards: figures are from the foundation's e-filed returns (IRS XML), checked against the ProPublica scans where they exist.
  • Tax years ending 2006–2009: figures were read from the scanned or printed returns. Line 25 and the grant statements were checked against each other.
  • No ProPublica scan exists for the return for the tax year ending November 2017. It is covered here from the e-filed version.
  • The return for the tax year ending November 2018 reports no grants paid.
  • Grants received by the recipients are not covered here. Many of them are churches or religious bodies that do not file Form 990, so these returns are often the only public record of the money.
