Zirkind was arrested in Toronto in 2014 after police stopped his rental car on a highway leading to Montreal and discovered $1,136,555 in cash hidden in duffle bags. Traces of cocaine were found on the money and throughout the vehicle. At trial he claimed the cash was “Shoah Gelt” – money being moved for safekeeping on behalf of European and Asian Jews who feared another Holocaust – and that he had been asked to transport it by a man named “Avrum Reish” as an act of religious charity (mitzvah). The jury rejected this defence and convicted him of possession of property obtained by crime. He was sentenced to four years in a federal penitentiary in Saskatchewan. His appeal, arguing he was merely a “simple courier” and the sentence was too harsh, was dismissed by the Ontario Court of Appeal in 2019; the court ruled that the evidence showed he acted for profit and knew the money came from drug trafficking.<ref name="TorontoSun2019" /><ref name="TheJC2019">The Jewish Chronicle, [https://www.thejc.com/news/world/banknotes-in-my-car-were-shoah-gelt-strictly-orthodox-drugs-trafficker-claims-yl3jaedu Banknotes in my car were 'Shoah Gelt', Strictly Orthodox drugs trafficker claims] ''The Jewish Chronicle'', 14 June 2019.</ref>

The Zirkind family has deep roots in Montreal’s Chabad-Lubavitch community. Mark Zirkind’s brother, Zalman Zirkind, served for many years as secretary and director of the [[Colel Chabad Lubavitch Foundation of Israel]], a Montreal-based Chabad charity later revoked by the Canada Revenue Agency in 2022 amid serious compliance failures and suspected money laundering links. Mark’s son Benzion Zirkind was also convicted in a related US federal money laundering case in 2021. The family’s criminal activities spanned Canada and the United States and involved laundering proceeds from international narcotics trafficking through networks in New York, Hong Kong, Israel, Colombia and Mexico.<ref name="LostMessiah2019" /><ref name="Mondoweiss2024">Mondo Weiss, [https://mondoweiss.net/2024/11/a-look-at-five-pro-israel-organizations-that-lost-charitable-status-in-canada-and-the-mega-donors-who-funded-them/ A look at five pro-Israel organizations that lost charitable status in Canada] ''Mondo Weiss'', 11 November 2024.</ref>

Mark Zirkind admitted to making multiple prior trips transporting large sums of cash between Toronto and Montreal. Police evidence included cocaine residue on the cash bundles and vehicle surfaces. The trial judge described the offence as serious and noted that Zirkind’s religious background did not mitigate his knowing participation in the laundering of criminal proceeds. After serving his sentence he returned to the Montreal Chabad community, though the family’s wider involvement in similar schemes continued through his relatives.<ref name="TorontoSun2019" />

On 23 February 2014 Zirkind met Justin Soon at Yorkdale Mall after flying from Montreal to Toronto. Later that night the Ontario Provincial Police stopped his rental car travelling east on Highway 401, arrested him and seized $1,136,555. The agreed statement of facts stipulated that $250,170 received from Soon was derived from cocaine trafficking. The bags, cash and several surfaces in the car tested positive for cocaine.<ref name="ONCA2019" />

At trial Zirkind said he believed the money was “Shoah Gelt”, belonging to Jews in Europe or Asia who feared another Holocaust, and that he was transporting it at the request of “Avrum Reish” as a mitzvah. He admitted making three or four previous trips transporting money from Toronto to Montreal. The trial judge rejected his account. Following a judge-alone trial before Justice Todd Ducharme, convictions were entered on 16 January 2017; on 29 June 2017 he was sentenced to four years' imprisonment. On 16 May 2019 the Ontario Court of Appeal dismissed the conviction appeal, granted leave to appeal sentence but dismissed that appeal too. It found the record supported the trial judge's conclusion that Zirkind acted for profit and knew he was transporting criminal proceeds.<ref name="ONCA2019" />

Mark Zirkind is a Montreal man convicted in Ontario of trafficking in and possession of property obtained by crime. The Ontario Court of Appeal described him as an “orthodox Lubavitch Jew”.[1]

Family and Chabad connections

In its sentencing letter concerning Zalmund (Zalman) Zirkind in the separate New York case, the US government identified Mark as the defendant's brother, referring to Mark's Canadian conviction and four-year sentence. This relationship was stated by the prosecution, not determined by the Ontario court.[2] Benzion Zirkind is identified as Zalmund's nephew by both the government and his own lawyer. Benzion's lawyer referred to his father's arrest but did not name his father; that filing does not establish that Mark is Benzion's father.[3]

Criminal activities and sentencing

On 23 February 2014 Zirkind met Justin Soon at Yorkdale Mall after flying from Montreal to Toronto. Later that night the Ontario Provincial Police stopped his rental car travelling east on Highway 401, arrested him and seized $1,136,555. The agreed statement of facts stipulated that $250,170 received from Soon was derived from cocaine trafficking. The bags, cash and several surfaces in the car tested positive for cocaine.[1]

It found the record supported the trial judge's conclusion that Zirkind acted for profit and knew he was transporting criminal proceeds.[1]
