== Health and food ==

[[Anna Laukkanen]] is the Whitehouse consultant that specialises in health policy and regulation, particularly in obesity, food and nutrition issues. The Whitehouse website states she played a "key role in our successful lobbying campaign in Brussels on the Regulation on Nutrition and Health Claims Made on Food".<ref>

The regulation (Regulation (EC) No 1924/2006 on nutrition and health claims made on foods) was drawn up to "prevent unfounded claims on food packages and to ensure effective functioning of the internal market as regards to nutrition and health claims. ".

The proposal covers two categories of claims: nutrition claims (such as "rich in vitamin C" and "low in fat") and health claims (such as "good for your beauty and your inner harmony") and proposed allowing a category of previously prohibited claims relating to the reduction of disease risk.<ref> http://www.euractiv.com/en/health/nutrition-health-claims-foods/article-133154 accessed 1 December 2007</ref>

The food industry reacted to the proposed regulation by employing PR and lobbying companies to try to kill off or at least amend the regulation.

The controversial areas were Article 4, which laid down the conditions for restricting the use of nutrition and health claims. It called on the Commission to establish nutrient profiles (with reference to fat, sugar and salt/sodium content) for each food category within 18 months from the adoption of the regulation.
Another area of contention was article 15, which required certain health claims to go through an authorisation procedure and stipulates that "the proposed wording of the health claim is substantiated by scientific data".

The food industry claimed that the proposed regulation was " an overly-burdensome regulation that will provide very little, if any, benefit to the consumer. This proposal exceeds the powers of the EU to interfere in Member State health policies and would adversely impact on food marketing and advertising, thus removing information from the consumer." Over 269 amendments were laid to the regulation.<ref>

Whitehouse also lists the [[Health Food Manufacturers’ Association]] HFMA as a client and states that:

Active involvement with Parliamentarians both in Westminster and in the European Parliament was initiated and developed to position the HFMA as the source of authoritative information, comment and advice on the regulation of the sector.... lobbying visits to the European Parliament, meetings as the European Commission, and a willingness to challenge regulatory decisions in the High Court and the European Court of Justice have all been key elements of the strategy....Firm and robust commitments have been achieved both from the UK Government and from the European Commission about the way in which legislation will in future be developed and implemented."<ref>

The consultancy also lists [[Vitabiotics]] as a client and states that:

The proposed EU regulation on nutrition and health claims, presented by the European Commission in 2003, proposed setting up a system of prior authorisation for all nutrition and health claims across the EU. This burdensome regulation, which would also have prohibited general well-being claims, would have threatened many existing products and caused significant delay to bringing new products to market...Whitehouse...worked with Vitabiotics to ensure that the company was seen by MEPs and by member state officials as trusted partners throughout negotiations. By working with MEPs as they drafted particular amendments we were able to help ensure that such amendments addressed key concerns and defended the company’s interests.As the legislation progressed we also worked closely with supportive UK Parliamentarians, holding a briefing in the House of Lords, planting Parliamentary Questions and encouraging them to make representations to the Secretary of State and EU Commissioners. The legislation was significantly improved. Vitabiotics is now working closely with the UK government and its regulatory agencies in relation to the interpretation and implementation of the legislation, and has significantly boosted its profile during the process."<ref>

==Overview==

Burson-Marsteller (B-M) is one of the largest public relations (PR) agencies in the world and also the most notorious. When helping its industry clients to escape environmental legislation or sprucing up the image of some of the most repressive governments on Earth, B-M brings to bear state of the art techniques in manipulating the mass media, legislators and public opinion.

In spite of B-M's claims that the best way to deal with problems is to put one's own house in order, the usual effect of PR is to maintain the status quo. By manipulating public opinion PR diverts attention away from difficult issues and creates the illusion of change so that a company or government can go about business as usual without having to worry about its reputation. By lobbying government and creating Astroturf campaigns PR helps to maintain a legislative environment on which industry can avoid real change.

===Market share/importance===

Whilst in recent years Burson-Marsteller slipped back from the number one spot it remains one of the largest PR firms in the world, and with recent restructuring looks set for strong growth in the coming years. Since 1979 the company has been a part of the [[Young & Rubicam]] Inc. advertising conglomerate, which in turn was acquired by [[WPP]] Group plc {{ref|1}}, the global communications services company, in October 2000. Its revenues for 2000 totalled $175m in the US and $303m worldwide, the highest in its history.

Today Burson-Marsteller employs 2,000 people in more than 60 offices in 35 countries around the world. That gives it a more international presence than any other agency, which is both an advantage (the firm is still the first choice for clients looking for genuine global reach) and a disadvantage.

B-M's reliance on international business makes it vulnerable to economic downturns or under-performing offices, as well as currency fluctuations. In recent years the Asian market was under-performing, then Europe, which was flat last in 1999. But B-M Europe has now moved back to a geographic structure - a reversal of the practice area commitment the agency made five years ago - more suited to local conditions, and that should spur growth. Meanwhile, the firm is picking up high-profile wins in Asia, like the Hong Kong government's economic development program, and expanding in Latin America, where it has a strong e-commerce practice.

Founded in 1953 by [[Harold Burson]], a freelance PR man and [[Jim Marsteller]], owner of Marsteller Advertising, Burson-Marsteller has grown to become one of the largest PR agencies in the world and a market leader in all of the major areas of PR services.

Harold Burson’s original vision for the new company was to model it on [[Hill & Knowlton]] then the clear leader in the PR sector. He quickly took the company into new fields of PR wanting to diversify into new fields from his original speciality in business-to-business communications. B-M quickly set up offices across the USA and began to pursue larger and more prestigious clients. By 1959 revenues had reached nearly half a million dollars.

Although not yet a top-tier PR firm, B-M took the gamble of moving into the European marketplace in the 1960s, a move that only [[Hill & Knowlton]] had previously taken. B-M established offices in London and Paris as well in Washington DC, and Los Angeles during the sixties.

Throughout the 1970s B-M continued to expand. In 1970 it entered the field of consumer public relations with its acquisition of [[Theodore R. Sills]] Inc. And it opened further offices in Frankfurt, Hong Kong, Singapore, Kuala Lumpur, Sao Paolo, Bahrain and in Russia. In 1979 B-M was acquired by the [[Young & Rubicam]] group of companies, and could thus begin to integrate its services with a family of other companies practising PR, lobbying and advertising.

In 1983 B-M's revenues exceeded those of [[Hill & Knowlton]] and in 1985 it was the first PR company to earn $100m in a year. The company’s expansion was relentless and yet more offices opened across the United states and around the world.

After years as the premier public relations agency, a position that became unquestionable after [[Hill & Knowlton|H&K]]'s partial collapse in the early nineties, B-M saw its leadership position erode throughout the '90s, thanks to internal problems and the fact that several other agencies improved dramatically over the same period. With recent restructuring however it has shown strong growth and in 2000 earned $303m placing it fourth in the league table of global PR firms {{ref|3}}.

In 2000 [[Young & Rubicam]] was itself acquired by the [[WPP]] Group. So now Burson-Marsteller works in an even larger family of companies including its old rival [[Hill & Knowlton]].

In the 1960s B-M worked for the Nigerian government to spin the crushing of the Biafran revolt. A subsidiary of Burson-Marsteller, [[Black, Manafort, Stone & Kelley]], also worked with the Nigerian military junta in the early nineties. During this time there were routine human rights abuses against protestors such as the Ogoni, who were non-violently campaigning against the oil-giant [[Shell]]. {{ref|greenbacklash}}

====Spining torture in Argentina====
In the seventies, after a military coup in Argentina, B-M was hired to improve the country's image. During this period, an estimated 35,000 people disappeared and thousands were tortured. Some of the torture techniques used during this period were ''el submarino'' (holding a person's head under water or excrement until near drowning), ''la picana'' (electric prod applied to the most sensitive parts of the body), rape, torture (tearing out toe nails) and putting live rats onto the body to feed on fresh wounds. {{ref|greenbacklash}} A book was written on the disappeared called ''Nunca Más'' ('Never More') {{ref|book}}.

B-M also worked with Indonesia when it was acused of genocide in East Timor.

===Major polluters===
B-M has a history of working with major polluters.

*In the seventies B-M worked with [[Babcock and Wilcox]] after the Three Mile Island nuclear disaster. The following decade, it worked with [[Union Carbide]] after the Bhopal disaster in India, which caused death or injury to tens of thousands of people. According to the lease agents these offices had lain empty for some months. Offices in this block cost between £35-45 per square foot depending in how high they are (in November 2004). 2) '''Daily Mail''' 
The [[Daily Mail]]'s frenzied campaign for a referendum on the proposed EU constitution may convince readers that the main issue is jobs, homes and pensions but there is a more pressing agenda behind the patriotic call to arms. One early casualty of a new constitution would be Lord Rothermere, the Mail's controlling shareholder. He would almost certainly be kicked out of power.

So worried is the tycoon that he is conducting a personal campaign against the proposed legislation, lobbying officials in Downing Street and travelling to Brussels to press his case in person. Last week, in what was hyped as its own referendum, Daily Mail readers were urged to join his calls for a vote on new EU suggestions.

Rothermere's troubles centre on EU proposals on mergers and acquisitions, which had been expected to be agreed by July 1. Under articles 9 and 11, individuals would be prevented from owning "multiple voting rights": in effect, controlling shares such as those in DMGT, whereby Rothermere controls 80 per cent of the voting shares even though he and his family own just 19 per cent of the equity.

Sources say that, given DMGT's current market value of GBP 2.42 billion, less than half that of three years ago, it could fall prey to a foreign takeover. An EU executive source said: "If the new EU proposals came in, Rothermere would be gone. At that value, DMGT would be swallowed up." It is understood that, late last year, Rothermere personally visited EU Internal Market Commissioner Frits Bolkestein to try to persuade him to drop the new directive. Sources suggest the meeting may have been organised by media lobby group APCO, which may have also been used to lobby several MEPs on Rothermere's behalf.

Rothermere may have had some success so far, with the EU unlikely to agree any changes before Greece hands over its presidency of the EU on July 1, but the deadlock is largely down to the lobbying of more powerful tycoons such as Sweden's Wallenberg family, which controls several public companies despite having a minimal capital outlay.

The EU source said:

:"Rothermere came banging his drum because he is worried that, if it went through, he couldn't keep 80 per cent control of DMGT. He'd have to give ordinary shareholders the same voting rights and that would be the beginning of the end for him. He put a good case but the reason for the deadlock is because of lobbying from the likes of the Wallenberg family. These are serious players."

An EU spokesman added: "All I can say is that, after 15 years of negotiations, we are probably back to square one on this." Rothermere, meanwhile, is taking no chances and, through his Mail newspapers, has stepped up his personal campaign for a referendum on the new EU constitution.
